Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period is 14 days from the day:
- on which you or a third party other than the carrier designated by you took possession of the goods, provided you ordered one or more goods within one order and these were delivered at the same time;
- on which you or a third party other than the carrier designated by you took possession of the last goods, provided you ordered several goods within one order and these were delivered separately.
To exercise your right of withdrawal, you must notify us (UrbanGetup) of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post, fax, or email). You may use the attached model withdrawal form for this purpose, but this is not mandatory.
To comply with the withdrawal period, it is sufficient that you send your notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
Consequences of Cancellation
If you cancel this contract, we will refund all payments we have received from you, including delivery costs (except for additional costs resulting from your choice of a delivery method other than the standard delivery offered by us), promptly and at the latest within 14 days from the day on which we received notification of your cancellation of this contract.
For this refund, we will use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; under no circumstances will you be charged any fees for this refund.
We may refuse to refund until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us promptly and at the latest within 14 days from the date on which you notify us of the cancellation of this contract. The deadline is deemed to have been met if you send the goods before the expiry of the 14-day period.
You will bear the direct costs of returning the goods.
You only have to pay for any loss of value of the goods if this loss of value is due to handling of the goods that is not necessary to check their quality, properties, and functioning.
Exclusion or expiration of the right of withdrawal
The right of withdrawal does not apply to contracts:
- for the delivery of goods that are not prefabricated and whose production is based on an individual selection or specification by the consumer;
for the delivery of goods that are subject to rapid perishability or whose expiration date would be exceeded; - for the delivery of alcoholic beverages whose price was agreed upon at the time of conclusion of the contract, but which are delivered no earlier than 30 days after conclusion of the contract and whose value is subject to market fluctuations;
- for the delivery of newspapers, magazines, or illustrated magazines, with the exception of subscription contracts.
The right of withdrawal expires prematurely for contracts:
- for the delivery of sealed goods which, for reasons of health protection or hygiene, are not suitable for return if their seal has been removed after delivery;
- for the delivery of goods which, due to their nature, have been inseparably mixed with other goods after delivery;
- for the delivery of audio or video recordings or computer software in sealed packaging if the seal has been removed after delivery.
